As per local reports After the tragic incident of a Sicily yacht Bayesian, a 183-foot-long superyacht that sank on Aug.9 and killed seven people, the captain of the yacht is under investigation.
The Captain Under Investigation
As per authorities, the yacht boarded 22 people, including 12 passengers and 10 crew. Seven people died while fifteen people were rescued.
As per Ansa, the Italian news agency, James Cutfield, 50, of New Zealand, the boat’s captain is now officially under investigation for “negligent shipwreck and multiple counts of negligent homicide.”
The agency said the captain was questioned for the second time in a week by prosecutors from the Termini Imerese Prosecutor’s Office on Aug. 25, focusing on the keel position, hatch status, and the timing of raising of alarms following the bad weather conditions.
Ansa noted that in the two-hour session on Sunday, authorities reconstructed the 32 minutes from when the sailboat began taking on water to the firing of the first distress flare at 4:38 a.m. This timeline was previously outlined by the prosecutor at a press conference.
“Does Not Imply Guilt”
In a report by People, an Italian criminal lawyer said that this “does not imply guilt (innocent until proven guilty) and does not automatically mean charges will be brought against the person.”
Adding, “It does mean that the people under investigation are able to appoint their own medical expert to the autopsies that are taking place their week, a very useful defense measure if they are later formally charged at a later date.”
Giornale di Sicilia, a Local newspaper, claimed that before the autopsies, the captain had been invited to appoint a defense lawyer as the autopsies are expected to start on Monday, Aug. 26 till Thursday, Aug. 29.
