Jussie Smollett is back and the City of Chicago wants the “Empire” actor to pay $130,000 for the fake hate crime he did earlier this year. However, a hearing is set in the city of Chicago’s effort to recover the costs from him after police said his claims of a racist and anti-gay attack were a fake. The status hearing Tuesday is the first hearing since the lawsuit has moved to federal court from state court in July.

Back story

Earlier in January, Smollett had told Chicago police that he was the victim of a racist, homophobic attack. But in reality, the actor allegedly hired two brothers to pretend to attack him. The reason was so weird that he was unhappy with his payment for appearing in “Empire.”

“On January 29, 2019, Defendant submitted a false police report claiming that he was the victim of a racist and homophobic beating by unknown attackers,” the lawsuit states. “In reality, the Defendant knew his attackers and orchestrated the purported attack himself. Later, when police confronted him with evidence about his attackers, he still refused to disclose his involvement in planning the attack.”

The thing is not only is the City of Chicago suing but the actor Smollett is also considering a lawsuit as well. However, Smollett’s attorneys wrote, “Defendant contemplates filing an action against the City of Chicago and/or its agents for their conduct underlying the arrest and their conduct thereafter including constitutional claims and state law claims. Defendant reserves the right to bring such claims at the appropriate time provided by law.”

However, Attorneys for the former “Empire” actor said assertions that Smollett prepared the incident are defamatory. They’re asking U.S. District Judge Virginia Kendall for the lawsuit. She’ll look into the matter.
